HYPEACH COLLECTS PERSONAL INFORMATION

HYPEACH collects information about you from: (1) what you may provide us when you interact with HYPEACH; (2) data that is collected automatically as you use the Platforms; (3) inferences we may generate about you; and (4) information collected about you from other sources. 2. PERSONAL INFORMATION YOU PROVIDE DIRECTLY

Personally identifiable information (“Personal Information”) may be collected online through order placement on Hypeach.com, creating a HYPEACH account, and/or offline through phone orders.  All Personal Information is collected with your consent and directly from you.  Personal Information includes, but is not limited to, your name, billing and shipping addresses, a HYPEACH username and password, email address, phone number, birthdate, payment data you provide to us, photos, reviews, emails, chat content, and other feedback you submit.  If we decide to use your Personal Information for a purpose that is materially different than what we have stated here, we will obtain your consent to use this information for the new purpose. 

3. PERSONAL INFORMATION COLLECTED AUTOMATICALLY 

Certain Personal Information is collected automatically when you use our Platforms. This Personal Information generally falls into these categories:

Purchase histories: We maintain a record of your past purchases to assist you with returns and exchanges, as well as future orders.

Device data:  When you visit our website, we collect your IP address. If you access our website from a mobile device, we collect unique device IDs.

Location data: We collect location data, which helps us understand where our customers are located.

Interactions data: We maintain a record of your activity on our online Platforms, including how you use our Platforms, which products you view, and which emails you receive. We also collect information about the site you visited before navigating to our Platforms.

Some of this information is collected via cookies, as described below. We may connect Personal Information collected automatically with data we already have about you, so we can identify you as a HYPEACH customer.  This allows us to provide the best shopping experience possible. COOKIES.  HYPEACH uses “cookies” to identify visitors to our website, including essential cookies, analytics/statistics cookies, and marketing-related cookies. 5. YOUR FINANCIAL INFORMATION

If you are making a purchase on the Platforms, you may be asked to provide credit card information.  We do not collect, store, or access any credit card information  other than possibly the last four digits of your credit card number for business processing purposes. Our payment gateway is managed by PayPal. If you enter your credit card information on our site, PayPal will process the transaction and retain a record of it.  HYPEACH keeps no record of your full credit card number. If you checkout using your personal Amazon or PayPal account, then that organization will process the transaction using financial information you have previously provided to it.  Please see the “Payment Transactions” section in our Terms of Use for additional information.

HOW YOUR INFORMATION IS USED

Information that you submit about yourself may be used by HYPEACH to provide the Platforms to you; to confirm and process your order and to maintain your purchase history; to contact you regarding updates to your order or to remind you about items left in your online shopping cart; to share the content you submit; to send you information regarding website and product updates, special promotions, new store openings, etc. (marketing information may be provided via mail or email); to comply with regulatory requirements and internal policies for maintaining records; to conduct internal reviews of our Platforms and to help us better understand how you use our Platforms; to tailor our product offerings and marketing promotions and make your shopping experience more enjoyable and convenient; to ensure that we’ve responded to your inquiries; to protect the security and integrity of our Platforms; to comply with court orders and legal process, and to enforce our Terms of Use and Privacy Policy; and for any other legal business or marketing purposes that are not inconsistent with the terms of this policy. We also reserve the right to share aggregate statistical data of which your Personal Information is a part, as well as your specific Personal Information sometime in the future.

Under the laws of some jurisdictions, you may be entitled to request disclosure regarding how we share your information with third parties for direct marketing purposes.  To the extent required by applicable law, we shall provide the information to you upon your written request to HYPEACH.

Except for the reasons we have made you aware of, or make you aware of from time to time, or otherwise with your consent, we will not share your Personal Information with any third party.

 

THIRD-PARTY ADVERTISING

EMAIL

We know you love email! And we love to tell you about new arrivals. So we send emails to notify customers about new arrivals and special events. New arrivals can happen twice a day, so we may send ten or more emails per week. You will only receive emails if you opt in to our email marketing. You may opt out at any time by clicking the unsubscribe link in the email, or by sending a request to support@hypeach.com. We may send you emails to confirm your order, send tracking information, or to communicate with you specifically about your order, or in response to a question either to our email, chat, or any of our social media accounts.  

 

SOCIAL MEDIA

We are active on many social media sites and we love to spend time with you there. Please know that we cannot constantly monitor our social media pages and that any information that you share may be viewed by others.  Additionally, when you use hashtags #HYPEACH, or other HYPEACH-related hashtags on Instagram, or other social media platforms, your photos and/or posts may automatically become part of a public gallery on our Platforms.

 

MOBILE APPLICATIONS

We may offer mobile applications for public consumption and/or download (the “Apps”).  We may collect information about the type of device an operating system you use.  We may ask you if you want to receive push notifications about activity in your account.  If you have opted-in to these notifications and no longer want to receive them, you may turn them off through your operating system.  We do not access or track any location-based information from your mobile device unless you have given us permission.  We will use commercially reasonable efforts, given the limitations imposed upon us by third party provides such as Apple, Inc. and Google, Inc. to clearly disclose what, if any Personal Information or usage information is collected by the Apps, how it is used, and with whom it is shared.  In the event that it is not commercially feasible for us to provide this explanation in advance of you accessing and using the Apps, this Privacy Policy shall govern any information collected by us as a result of your use of the Apps.

 

Please note, certain practices are outside of HYPEACH’s control, including any tracking by Apple, Inc. and Google, Inc. or your third-party telecommunications carrier of which Apps you download.  We cannot and will not be held responsible for the actions of such third parties.  You should always read and understand the policies of any third-party provider before making any purchase or downloading any of the Apps.

 

TEXT (SMS) MESSAGING

DATA RETENTION

We may retain your Personal Information and any messages for as long as we need it to provide you with our products and/or services under the Platforms.  HYPEACH is not liable for any information that may be deleted from the Platforms.  Please note that there may be latency in deleting your Personal Information from our servers and backup storage.  We may be allowed to retain your Personal Information for a longer period whenever you have given consent to such processing, as long as such consent is not withdrawn.  We may retain your Personal Information in order to comply with the law, protect our rights, resolve disputes, or enforce our agreements.

 

SECURITY PROCEDURES

HYPEACH takes commercially reasonable precautions and has implemented commercially reasonable technical, physical, and administrative safeguards and measures intended to protect against the risks of unauthorized access to, erroneous disclosure of, and unlawful interception of Personal Information submitted via the Platforms.  However, your e-mail transmissions and/or other communications containing Personal Information may be unlawfully intercepted and/or accessed by third parties and/or the Platforms may be subject to hostile network attacks or administrative errors.  We cannot and do not guarantee the security of any information transmitted over the Internet, or other electronic means.  We take steps that we believe are commercially reasonable to limit access to your Personal Information to only those whom we determine need access to provide requested products, services, offers, or opportunities that may be of interest to you.  We cannot guarantee that your Personal Information may not be accessed, disclosed, altered, or destroyed as a result of a breach of our commercially reasonable efforts or as a result of any event beyond our reasonable control.  Accordingly, we do not guarantee that your Personal Information is completely secure and safe from such risks.  We expressly disclaim any representation or warranty, express or implied, with respect to ensuring, guaranteeing, or otherwise offering a definitive promise of security in connection with your Personal Information or Usage Information.

 

DO NOT TRACK.  

Do Not Track (“DNT”) is an optional browser setting that allows you to express your preferences regarding tracking across websites, and some web browsers (including Safari, Internet Explorer, Firefox and Chrome) have a DNT feature that tells a website that a user does not want to have his or her online activity tracked.  If a website that responds to a DNT signal receives a DNT signal, the browser can block that website from collecting certain information about the browser’s user. Not all browsers offer a DNT option and DNT signals are not yet uniform. For this reason, many businesses, including HYPEACH, do not currently respond to DNT signals.

 

MINORS

Hypeach does not direct our website or any marketing materials to minors and do not knowingly collect specific Personal Information on minors.

 

COMPLIANCE WITH THE CHILDREN’S ONLINE PRIVACY PROTECTION ACT

We recognize the need to provide further privacy protections with respect to Personal Information we may collect from Children who use our Platforms. For that reason, we make every effort to comply with the regulations of the Children’s Online Privacy Protection Act of 1998 (15 U.S.C. § 6501 - 6506). We never collect or maintain Personal Information through the Platforms from those we actually know are under thirteen years of age, and no part of the Platforms are structured to attract anyone under thirteen years of age. We expressly disclaim, and you expressly release us from, any and all liability whatsoever for any controversies, claims, suits, injuries, harm, loss, penalties, damages, arising from and/or in any way related to any misrepresentations regarding the age of any user. We reserve the right to suspend and/or terminate with or without notice the license to access the Platforms of a user who we believe has provided false information when registering for and/or using the Platforms and each user agrees to make no further use of the Platforms after termination and/or during suspension.

 

LINKED SITES

The Platforms and/or third parties may provide links to Linked Sites and data provided by third parties. However, we are not responsible for the privacy practices employed by Linked Sites, nor are we responsible for the information or materials that third-party data contains. This Policy applies solely to information collected by us through the Platforms. When you use a link to go from the Platforms to a Linked Site, this Policy is no longer in effect. We encourage users to read the privacy policies of Linked Sites before proceeding to use them. When you conduct e-commerce with a Linked Site, certain Personal Information may be collected by the Linked Site and made available to us.

 

CALIFORNIA PRIVACY RIGHTS

FOR USERS BASED IN CALIFORNIA.  This section provides additional details about the Personal Information we collect about California residents and the rights afforded to them under the California Consumer Privacy Act (“CCPA”).

Collection of Personal Information.  In the last 12 months, we collected the following categories of personal information: identifiers (such as name, contact information, IP address and other online identifiers), demographic information (such as gender), commercial information (such as products purchased), Internet or other electronic network activity information (such as browsing behavior), geolocation data, audio, electronic, visual, or similar information (such as profile information and customer support calls), inferences (such as shopping behaviors) and other personal information (such as payment method information).
